United States Disitrict Federal Judge David C. Godbey is allowing a class action lawsuit against True.com to proceed after rejecting True.com's legal request for a summary judgment.
The case is in regards to a class action lawsuit that was filed by Thomas Wong in June 2007, alleging fraudulent billing practices by online dating service True.com. The main complaint is that True.com continued to charge many members after they had canceled their membership.
The ruling against True.com's summary judgement request was issued on December 3, stating (in part):
"Because there are genuine disputes of material fact regarding the validity of the November 2006 and February 2007 charges to Wong's credit card, the Court denies True's motion for summary judgment."
The news comes one month after True.com won a victory in California where a gender price discrimination lawsuit against the service was thrown out because the person bringing the lawsuit never paid for the service and therefore lacked standing to file the lawsuit.
